
I have been in the staffing industry for almost 30 years. In all that time I have seen a lot of crazy things. But over the past few years, one of the biggest issues facing businesses is staffing firms with a pricing structure so low they are losing money on every hour they bill. So why are they doing it, and what does it mean for your business if you work with them?
“Cut-rate staffing sounds like a wonderful thing, until it quietly becomes a liability that ends up costing your business far more than it ever saved.” If a staffing agency significantly undercuts the competition on price, it is a safe bet they are cutting corners that get them into serious trouble. And in Ontario, they are starting to get caught.
In one recent case, an Ontario temporary help agency was fined $100,000 after admitting it had given false records to a regulator and obstructed an investigation into a possible Employment Standards Act breach. That is not a paperwork infraction, that is deliberate non-compliance. And if your business works with them, it is on your business too, whether you like it or not.
In another Ontario case, two directors of a staffing agency were convicted of fraud after stealing from the business and under-reporting more than $2.8 million in income. They were fined hundreds of thousands of dollars each.
Then there is the Temporary Foreign Worker piece. An employer in Toronto was fined $111,000 for failing to deliver on promised wages, job type, and working conditions. These infractions often come from backroom deals made by third-party recruiters or agencies. TFW fines in Canada have climbed into the millions as enforcement gets more robust.
Ontario has further regulated the industry by requiring temporary help agencies to become licensed, with penalties for non-compliance reaching as high as $50,000.
What Do You Risk If You Use One of These “Bad” Agencies?
Using a non-compliant staffing agency is not just their problem, it is yours, and it becomes yours in a hurry. Here is how it lands on businesses.
1. Legal Liability (Yes, it can land on you)
If workers are not paid, misclassified, or not receiving overtime, regulators can go after not only the agency but also the client company. In Ontario, joint liability laws mean you are on the hook for unpaid wages, vacation pay, and ESA violations, even if you never touch payroll.
2. Fines, Back Pay, and Audits
Once an issue is identified, it rarely stays minor. You could be looking at back pay for several employees, government fines, and full audits of your business practices. That two dollars an hour in savings becomes a five- or six-figure problem.
3. Reputational Damage
If your agency is associated with worker exploitation, unsafe conditions, or questionable business practices, it will follow you. Customers, employees, and future recruits will notice. You do not want your brand tied to that.
4. Workplace Safety
Unscrupulous agencies skip training, documentation, and certification. Expect more workplace injuries, more WSIB claims, and potential shutdowns or investigations, on your floor.
5. Reduced Quality and High Turnover
The same agencies skip hiring standards and qualifications. You end up with unqualified workers, high turnover, and reduced productivity. You are not saving money, you are babysitting a revolving door.
6. Tax and Payroll Exposure
If your agency is not remitting CPP, EI, and taxes correctly, authorities will investigate the relationship. Even if you are not directly implicated, you are now stuck in a messy investigation.
7. Supply Chain and Contract Exposure
Larger clients and partners now ask about worker exploitation. If you cannot demonstrate worker safety and ethical labour practices, you can lose contracts, especially with firms that take corporate responsibility seriously.
Cheap Labour Is Not Cheap. It Is Delayed Risk.

If someone is significantly undercutting the market, do not ask how they are saving you money.
